LobitoWorks Terms of Service
★ I am happy to draft a professional contact laying out clearly deadlines, payment schedule, and other terms for your commission. Most clients prefer to not deal with contracts when commissioning us, so a contract will be drawn by request only.
★ You must be 18 or older to commission LobitoWorks.
★ By commissioning the LobitoWorks team, you are allowing us to take photos of the costume pieces with someone inside it for our portfolio and promotional purposes. Your character’s name/internet handle may be shared publicly, but your personal information (real name, address, etc) will remain private. We work in a smoke-free environment. We live with cats and dogs- fursuit projects are stored away from pet access, but if you’re severely allergic, you may wish to order from someone else.
AT THE BEGINNING OF THE COMMISSION…
★ After we agree on the design and price for your commission and you agree to this ToS, no changes can be made to your order! So please make sure you convey exactly what you want and are 100% happy with your design before the commission starts. If your design is complex or potentially confusing, consider having some sketches ready to show me.
★ Projects totalling $500 and under: Payment is due up front. Shipping costs may be either charged up front or once the commission is finished.
★ Projects totalling over $500: $500 is due up front as a non-refundable deposit. 50% of the remaining price is due once work begins on the project, with the remaining amount plus shipping due once the project is finished, before it ships. Client can optionally pay in full up front, but this does not typically affect the queue order. We accept most forms of payment.
★ For full body costumes we require a duct tape dummy and a few measurements. I can provide links to information on how to create an ideal duct tape dummy as well as the recommended supplies. The commission may be cancelled if the measurements/dummy aren’t sent within a reasonable amount of time, subject to artist's discretion.
★ The exception to the above is mascot costumes. If commissioning a mascot costume meant to be “one size fits all”, personalized measurements and duct tape dummy are not needed.
TURNAROUND TIME AND DEADLINES:
★ I’ll give you a rough estimate of when to expect your costume to be finished- this is subject to change. I will not delay your project in my queue to give you more time to gather money to pay it off- if you aren’t sure you can afford the project in the timeframe I have estimated, please wait to order until you’re ready.
★ If you require an exact deadline, let me know. The deadline fee ranges between +15%-50% depending on how far out the deadline is. Projects with a hard due date are required to be paid in full in advance. The deadline fee is refundable if your costume isn’t scheduled for delivery in time for your deadline. Deadline fee is separate from shipping costs- client may need to pay for expedited shipping in order to meet their deadline.
DURING THE COMMISSION…
★ Correspondence about your commission will be digital only, through email, Telegram, or Discord messaging. Once an avenue of communication has been established, it's prefered we stay on one platform so all our correspondence is in one place.
★ If you know in advance you’re going to be unavailable to contact for a while please let me know ASAP so I can plan accordingly. If the customer without warning stops replying to messages in excess of 30 days, I’ll try once more to reinitiate contact through all avenues possible, and if I still don’t hear anything after 45 days total, your commission will be treated as a customer cancellation, with loss of your $500 deposit.
★ As mentioned prior, remaining payment and shipping costs are due once costume is complete, before it ships. If final balance isn't paid within 60 days of costume completion, buyer forfeits ownership of the costume and a refund will be offered, minus the $500 deposit and any deadline fees, if applicable. Unclaimed costumes can be resold, repurposed, kept by us, or destroyed depending.
★ I normally ship via USPS, but can ship through other couriers by request. I typically calculate shipping costs at the end of the commission because it can vary drastically based on the weight and size of the finished costume. Extremely large costumes may require multiple shipping boxes and high shipping prices. LobitoWorks is not responsible for import fees that may incur if buyer is located outside the US.
CANCELLATIONS:
★ Refunds due to client cancellations are evaluated on a case-by-case basis based on how much work/time/money has been invested into the project already. I will always endeavor to do what is most fair for client and artist alike. Cancellations are final and cannot be reversed. Commission slots are non-transferrable.
AFTER THE COMMISSION…
★ Each custom commissioned piece comes with a 90 day limited warranty against defects at artist's discretion. You pay shipping back to us, but we will cover shipping back out to you. Please clean items before mailing back for repairs if they are dirty. We won’t honor the warranty for problems caused by user error or neglect, for example someone larger than the intended owner trying to force on a pair of paws, or having fur melt because it was put in the drier with heat.
★ Things that will void the warranty: Alterations to the costume not made by LobitoWorks, improper usage/storage/cleaning of costume, transfer of ownership of costume to a third party.
★ After the warranty has expired, repairs and alterations can be performed at a reasonable cost. A cleaning fee may be applied to your balance if you send your costume back dirty.
